DUIs in California

There are a number of ways in which an individual can face DUI charges in California.

  • If you are over the age of 21 and have a regular driver’s license with no restrictions, you can be arrested for a DUI if your blood alcohol concentration (BAC) is .08% or greater.
  • If you have a commercial driver’s license and have a BAC .04% or greater, you can be arrested for a DUI, regardless of the type of vehicle you are driving.
  • If you are currently on probation for a previous DUI charge and have a BAC that is .04% or greater, you can be arrested for a DUI charge.
  • If you are under the age of 21 and have a BAC of .01% or higher, you can be arrested for a DUI.

Moreover, it is possible to be convicted of a DUI even if your BAC is not above the legal limit if it can be determined that your judgment was impaired.

The Penalties

In California, if you have prior DUI offenses, your second, third, fourth, and any other subsequent offenses within a ten-year period will result in stricter penalties.

  • Second DUI Offense: License suspension lasting up to 2 years, up to a year in jail, fees up to $4,000, 3 to 5 years of DUI probation, DUI school, and required installation of an ignition interlock device.
  • Third DUI Offense: License suspension lasting up to 3 years, a year to 16 months in state prison, fees up to $18,000, 3 to 5 years of DUI probation, DUI school, and required installation of an ignition interlock device.
  • Fourth DUI Offense: License suspension lasting up to 4 years or permanently, up to 16 months in state prison, 3 to 5 years of DUI probation, DUI school, fees up to $18,000, required installation of an ignition interlock device, and the status of a convicted felon.
