DUIs in California
There are a number of ways in which an individual can face DUI charges in California.
- If you are over the age of 21 and have a regular driver’s license with no restrictions, you can be arrested for a DUI if your blood alcohol concentration (BAC) is .08% or greater.
- If you have a commercial driver’s license and have a BAC .04% or greater, you can be arrested for a DUI, regardless of the type of vehicle you are driving.
- If you are currently on probation for a previous DUI charge and have a BAC that is .04% or greater, you can be arrested for a DUI charge.
- If you are under the age of 21 and have a BAC of .01% or higher, you can be arrested for a DUI.
Moreover, it is possible to be convicted of a DUI even if your BAC is not above the legal limit if it can be determined that your judgment was impaired.
