Air Gauge Knives
Violation of California Penal Code § 20310 PC
In the state of California, there exists a statute known as Penal Code § 20310 PC that addresses the issue of air gauge knives, which are also commonly referred to as AGKs. These knives are objects that bear a resemblance to air gauges but conceal a knife within them. The law prohibits the creation, importation, sale, gifting, or possession of such knives, and violations carry penalties.
An air gauge knife is an item that resembles an air gauge while clandestinely housing a concealed knife. As per Penal Code § 20310 PC, it is considered unlawful for any individual within California to manufacture, cause the manufacturing, import, keep for sale, offer or expose for sale, give, lend, or possess an air gauge knife. Breaching this law can result in a maximum of one year of imprisonment within a county jail or imprisonment in accordance with subdivision (h) of Section 1170.
Let's consider a few examples of violations under Penal Code § 20310 PC. For instance, if Johnson gifts an air gauge knife to his acquaintance Clark, or if Clark takes possession of the air gauge knife from Johnson and stores it in his storage unit, or if Davis purchases an air gauge knife in a different state and transports it into California, all these actions would be deemed as violations.
Fortunately, individuals accused under Penal Code § 20310 PC have legal defenses at their disposal. These defenses encompass demonstrating that they did not possess an air gauge knife, proving that they belong to an exempted category of individuals who are immune from prosecution, or establishing that the act was carried out out of necessity.
It is crucial to note that violating Penal Code § 20310 PC can lead to either misdemeanor or felony charges, contingent upon the circumstances. Misdemeanor charges carry the potential penalty of imprisonment for a maximum of one year within a county jail and/or a fine of up to $1,000. Felony charges can entail imprisonment for a maximum of three years within a county jail and/or a fine of up to $10,000.
In addition to Penal Code § 20310 PC, there exist other related offenses that should be taken into consideration, including illegal acts involving ballistic knives (PC 21110), belt buckle knives (PC 20410), and cane guns (PC 24410). Each offense carries its own distinct set of penalties and can be charged as either misdemeanors or felonies, depending on the circumstances.
